PRECARIZAÇÃO NAS RELAÇÕES E CONDIÇÕES DE TRABALHO E AS OFENSIVAS NOS DIREITOS TRABALHISTAS

Abstract

Contemporary work has been permeated by a set of regressive offensives. This trend is an inseparable part of the dynamic scenario of the capitalist mode of accumulation which, to guarantee surplus value, uses different strategies to accelerate levels of exploitation, such as the flexibilization of labor, made viable by new forms of management and performance of work, as part of inseparable from productive restructuring and the rise of neoliberal ideas. These are elements that affect labor rights, which in Brazil, added to the restructuring/neoliberalism binomial, have seen their regression deepen, especially since the Labor Reform (Law nº. 13.467/2017). In view of this, the present study aims to understand and explain the main implications that this scenario implies in Labor Law and the precariousness of its relationships and conditions. To capture the main dimensions, the Marxian method of analysis, the bibliographic/webgraphic review and the Labor Reform Law were chosen as ways of approaching the procedurality of transformations imposed on work in the Brazilian scenario. The result of the study showed that flexibilization is a global and national trend, dictating significant subservience to the workforce, reaffirmed in the diverse changes and regressions in labor legislation. In view of this, it is concluded that contradictory offensives against work as a Social Right are underway, leaving the working class to organize collectively as one of the ways to resist super-exploitation and the capitalist drive for extraordinary profits.
